Terms of Service

These terms (“Terms”) govern your use of Better Tips’s website and app (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you use Better Tips on behalf of a business, you agree to them on that business’s behalf and confirm you have authority to do so.

The Service

Better Tips connects to your Square account with read-only access and turns your timecards, wages, and payments into hours, pay, and tip allocation reports you can review and export for payroll. Better Tips is an independent product and is not made, endorsed, or supported by Square, Inc. or Block, Inc.

Your account and team

• You must be at least 18 and able to form a binding contract.
• Keep your Google account secure. You are responsible for activity on your Better Tips account.
• You are responsible for the teammates you invite and for what they do in your team, including which reports and employee data they can see.

Square and your data

To use Better Tips you need an active Square account, and you must comply with Square’s own terms. You authorize Better Tips to read your Square data using the permissions you grant. You can disconnect Square at any time from your team settings.

You confirm that you have the right to share your employees’ data with Better Tips for payroll and tip reporting, and that you have given any notices to employees that applicable law requires.

Reports are not payroll or legal advice

Better Tips’s reports are calculated from the data in your Square account and the settings you choose. They are tools to help you, not a payroll service, and not tax, accounting, or legal advice. You are responsible for reviewing every report before relying on it, for paying your employees correctly, and for complying with wage, overtime, tip pooling, tax, and record-keeping laws that apply to your business. Results are only as accurate as your Square data, so errors in timecards, wages, or payments will carry into your reports.

Plans, billing, and cancellation

Personal workspaces are free. Team features require a paid plan, billed per seat through Stripe at the price shown at checkout. Paid plans renew automatically in advance each billing period until you cancel, and your seat count updates as members join or leave your team. Any free trial converts to a paid subscription unless you cancel before it ends. You can cancel at any time; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law. We may change prices with reasonable advance notice.

Acceptable use

You agree not to:

• Use the Service for anything unlawful, fraudulent, or deceptive.
• Access accounts, teams, or data you are not authorized to access.
• Interfere with or disrupt the Service, or try to bypass its security or limits.
• Reverse engineer, resell, or build a competing product from the Service.

Your data

You keep all rights to your data, including the data Better Tips accesses from Square. You give us permission to use it only as needed to provide and improve the Service. Our Privacy Policy explains how we handle it.

Our intellectual property

Better Tips, including its software, design, and branding, belongs to us and our licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service while your account is active. If you send us feedback, we may use it without obligation to you.

Suspension and termination

You may stop using Better Tips at any time by disconnecting Square, canceling any subscription, and asking us to delete your account at matt@mattech.fyi. We may suspend or end your access if you breach these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive termination will survive.

Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Better Tips depends on Square’s systems and APIs; we don’t guarantee the Service will be uninterrupted or error-free, that reports will be complete or accurate, or any particular business result.

Limitation of liability

To the fullest extent permitted by law, Better Tips will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, including wage, tip, tax, or penalty amounts arising from how you pay your employees. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US$100.

Indemnification

You agree to defend and indemnify Better Tips against claims arising from your payroll and tip practices, your use of the Service in violation of these Terms, or your violation of law or the rights of others, including your employees.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you by email or in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.

General

These Terms are governed by the laws of the United States and the state in which Better Tips’s operator is based, without regard to conflict-of-law rules. If any part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. These Terms and our Privacy Policy are the entire agreement between you and Better Tips regarding the Service.
